MLM Legality Test

There are many characteristics, or "red flags" that distinguish an illegal pyramid from a legitimate multi-level business opportunity, (often shortened to MLM.) They have been written about often in many publications and by necessity often contain legal terms and industry jargon.
Also, danger signs of a few years ago may have been camouflaged or fixed by the newest drafters of plans so one needs to be on guard for new and different twists. Is there a simple, easy to apply, test one can give to a business opportunity, that addresses the pyramid law risk without all the pyramid law legal terminology?
There is. What follows addresses that need. It is the single-level test for the multi-level business opportunity.
It goes like this:
Can one make some money SINGLE-LEVEL, that is, without sponsoring another business opportunity seeker?
Note the specific use of the word "can", not the word "would". It is usually a given that the business opportunity prospect is urged to sponsor, and that the business opportunity presenter will say or imply that the "real money" is in building a group.
But that is O.K., SO LONG AS - those who choose not to sponsor at all, CAN STILL MAKE MONEY.
Note also the use of the word "MAKE". It's "MAKE MONEY" not "SPEND MONEY", meaning paying income taxes if the gross income exceeds expenses associated with producing the income.
Buying for personal use at distributor prices rather than customer prices, while a savings, does not generate INCOME upon which one is required to pay taxes. Buying for personal use by itself is not an income opportunity.
If the proposed business opportunity consists ONLY of buying for personal use and sponsoring more representatives, with no provision for sales to customers, it is flawed.
This simple test needs to be applied to two aspects of a business opportunity. The first aspect is the design.
What do the company documents say about how one makes money?
How does the compensation plan work?
Not all the fine details of every commission, bonus or reward need be understood, but simply, can one make SOME money without sponsoring.
Remember, one does not MAKE money when one buys any product or service for personal use.
The application of this test should in no way imply that there is anything wrong or illegal about personal consumption. It is just that it alone cannot be the sole basis for a business opportunity.
The second aspect of the application of the test is the plan implementation. Some plans are designed correctly but are flawed in the implementation.
Can one make money, even without sponsoring, as the plan is being taught and implemented by the prospective sponsor and the distributors closely associated with him or her?
If there is no acknowledgment or support for the non-sponsoring participant in the business opportunity, something is wrong, maybe not in the design, but surely in the implementation.
Reputable and legally designed and implemented multi-level business opportunities provide a money making opportunity SINGLE LEVEL to those who choose not to sponsor.
Of course, if one sponsors others, then ADDITIONAL money making opportunities exist when those sponsored generate sales.
Apply this test to multi-level business opportunities. Look at the plan design, and look at the way the plan is being implemented by the prospective sponsor and associates.
If the ONLY WAY to make money is by sponsoring, STAY AWAY, the plan is fatally flawed.

An elevator speech is a short verbal snippet that clearly and memorably introduces you. It highlights your uniqueness and focuses on the benefits you provide.
Imagine... you step onto an elevator and there is a lone occupant waiting to travel with you to another floor.
You are together for less than a minute, but long enough to make polite conversation.
What you don't know is this person is your ideal client. She has a problem you can solve.
She cuts through the awkward silence and says, "I see you're attending the networking event as well. What do you do?"
Here it is! Your chance to make an impression and secure a new client.
After a short stammer, you answer with, "I'm a coach and a copywriter. I hold a Masters in Business Administration and have been running my own home-based business for ten years."
With only a few seconds left, the elevator doors open. She politely responds with a smile, then steps off the elevator, gone... forever.
After you finish banging your head against the button panel, you realize you not only blew it, but you now have an indentation of the twenty-first floor button on your forehead.
What if instead you had answered with:
"I help women entrepreneurs get more clients than they know what to do with and triple their profits in six months."
If she were your target client, do you think the second response would have sparked her interest and kept her on that elevator a little bit longer?
We all ask ourselves, "What's in it for me?" when engaged in any type of communication, whether written or spoken.
You want to take something of value from a conversation, learn something new, create a certain feeling, or receive information that will help you solve a problem or meet a need.
If you spend the first 30 seconds labeling yourself and listing your credentials, or going into a technical spiel of your product or service, you will be met with nothing more than a big fat yawn, a glazed-over look or even worse, "Excuse me, I have to make a call" and a quick exit.
Take the time to develop a benefit-rich, passionate elevator speech that will engage your listeners to want to hear more.
Write down a list of benefits your clients/customers receive from working with you or buying from you, and use those words and phrases in your benefit statement.
There's no need to label yourself. Labels don't provide the benefits the listener is looking for.
Once you have your elevator speech developed, practice it over and over until it's as natural as stating your name. You'll be able to use it at networking events, in telephone conversation, when leaving voice mail messages, in any type of written communication, and yes, especially in the elevator!
So, ____________, what do you do?

Publishers and webmasters provide content and news in an RSS feed. Users view the content of interest in an RSS reader or news aggregator. The aggregator or reader contains the collection of feeds that are of interest to the user.
As the RSS feed is updated the content in the reader or aggregator updates with the new information.
At any point, users can remove a feed from their aggregator or reader and no longer receive information from that source.
Ultimately, the user is choosing the news and content they wish to view.
As RSS has increased in popularity more and more webmasters and publishers have adopted RSS as an alternative communication stream. Webmasters use an RSS graphic to indicate the content is available via RSS.
RSS Aggregators and News Readers
Generally, there are three types of RSS readers that users use to view feeds that they've subscribed to. Feeds can be viewed in a desktop application, web-based aggregator, or plug-in aggregator.
Desktop RSS Readers
Standalone desktop applications generally run in the background, similar to an e-mail client, automatically refreshing headlines as newfeeds are updated. The RSS readers collect the feeds and refresh items in the feeds each time they are updated.
An example of a popular standalone desktop RSS reader is: FeedReader found at http://www.feedreader.com
Web Based Aggregators
Web-based news aggregators are online services. In simple terms, you can personalize a web page. Each time that page is accessed or each time you login to the service, the web page news headlines from feeds that you have selected will refresh.
Plug-in news aggregators expand the functionality of existing applications to allow users to veiw RSS feeds from within an existing program. Some plug-ins work with web browsers; others work with e-mail clients. An example of a plugin is: NewsGator Outlook - http://www.newsgator.com/outlook.aspx
Websites containing RSS feeds usually have a colorful graphic indicating the availability of an RSS feed. The graphic is usually marked 'RSS' or 'XML'. Simply click the graphic and enter the URL of the file into the reader.
Regardless of the RSS reader or news aggregator used by web surfers, the process of adding feeds is generally simple.
Web surfers need only to enter the URL of the RSS feed that they wish to view into their news reader. Each time the reader refreshes the feed the information contained within the feed is updated and new content in the feed will appear in the RSS reader.
